When I try to file in my case, I get a "Not Authorized to File" message. Why is that and what do I do to fix this issue?
You will see this message when you are not counsel of record in the case. Entering an appearance in a case does not automatically add you to the case, you must wait for the Court to process your appearance, meaning, add you to the case.
You can verify whether you are counsel of record by running the service list for the case (Reports > Service List). If you are not counsel of record, file a Notice of Appearance or Substitution of Counsel.
- File the Notice of Appearance or Substitution of Counsel document type via CM/ECF in the case.
A Notice of Docket Activity for your filing will be sent to the email address(es) linked to the attorney's CM/ECF account. This does not mean the attorney has been added to the case.
- Log out of CM/ECF.
- Wait for the Court to process your notice (meaning: wait for the Court to add you to the case).
A notice of docket activity saying the attorney has been added to the case will be sent to the email address(es) linked to the attorney's CM/ECF account.
- Log in to CM/ECF.
You should now be able to file in the case.
- To file a motion for attorneys fees (not under the Expenses Under the Equal Access to Justice Act).
Format the pleading as a motion and include all supporting documentation or Form 9. See 9th Cir. R. 39-1.6.
Type of Document: Motion for any Type of Relief (Other than Reconsideration or to Seal); Requested Relief: motion for attorney fees.
- To file an application for fees under the Expenses Under the Equal Access to Justice Act (EAJA).
Complete Form AO 291.
Type of Document: Application for Fees Under EAJA.
- To file a Bill of Costs.
Complete Form 10. See 9th Cir. R. 39-1.
Type of Document: Bill of Costs (Form 10).
